Our main fields of activities

The Lawyer´s Office Gaßner, Groth, Siederer & Coll. specializes in the law of environment, planning, building and nature conservation.

In particular:

  • Legal advice for communal bodies, government departments and waste disposal companies in the law of waste and water;
  • Legal advice and proceedings for government departments in the law of nuclear safty;
  • City planning and urban development, environmental protection in urban devolopment planning, consultancy for providing bodies of urban renewal and development, city building contracts, clarification of property matters according to property law;
  • Questions of nature conservation law (among others preparation of nature conservation state bills);
  • Problems of traffic law, preparation of traffic conceptions compatible with ecology, publications on the German "Verkehrswegeplanungsbeschleunigungsgesetz" (act on the acceleration of traffic infrastructure planning), legal advisory opinions concerning the possibilities of traffic restrictions for reasons of environmental protection;
  • Technical environmental protection and plant admissions (advice in proceedings for official approval and admission of plans in the sphere of law of protection against harmful wastes and effects on the environment);
  • Legal aspects of clearance and indemnity against liabilities of old environmental burdens.

Help in case of construction or rehabilitation

We give advice on the different aspects of the law of environment and planning in case of construction or rehabilitation of industrial or communal plants and attend responsibly to the respective permit and official approval procedures. There will be close cooperation with experienced environmental engineers and consultant´s offices. Some headings are:

  • Assessment of the situation with regard to the law of planning and of old environmental burdens as expert advice for location;
  • Requirements of the environmental impact analysis and examination of applications for admission from a legal point of view;
  • Procedural management and advancement of acceptance as well as attendance at explanatory hearings;
  • Legal representation in major administrative proceedings.

Administrative and communal advice

We are entrusted intensively with questions of administrative and communal advice. Essential points of main emphasis in this context are tasks related to the laws of nuclear safty, waste management and nature conservation in addition to the fields of energy and drinking water supply and sewage disposal. We, therefore, dispose of very good contacts to different administrative levels. Some headings are:

  • Assistance to the preparation of laws, statutory instruments and administrative regulations;
  • Elaboration of municipal ordinances and licence agreements;
  • Setting up of special purpose associations and foundation of providing companies (e.g. waste management companies, water supply companies etc.);
  • Realization of waste management concepts (e.g. waste recycling agency);
  • Attendance to plant projects.

Building regulations and project planning

We dispose of great experience in the sphere of the law of building regulations and project planning. Some headings are:

  • Foundation of development corporations (e.g. public private partnership);
  • Assessment of the situation with regard to the law of planning and of the possibilities of development by urban development planning ("Flächennutzungsplan" [Land Development Plan], "Bebauungsplan" [Building Scheme] "Entwicklungsplan" [Development Plan];
  • Carification of ownership rights with special regard to the current legislation related to investment promotion;
  • Assessments of liabilities for old environmental burdens and possibilities for indemnity against liabilities;
  • Preparation and realization of contracts and agreements related to urban and site development.

Our staff

Our office equipped with all the modern facilities is, at present, working with more than 25 specialized lawyers disposing of a wide range of experience, including in addition to the lawyer´s classical activities also competence in the spheres of environment policy and media work coming partly from former functions in parliament, administration and as judge in the Administrative Court.

The lawyers H. Gaßner, Dr. K.-M. Groth and W. Siederer are partners of "Mediation GmbH Berlin, Beratende Gesellschaft für Konfliktmittlung und Konsensfindung (MGB)" [Mediation Berlin, limited liability company]. Dr. K.-M. Groth is judge of the constitutional court of Berlin.
